A six-year patent infringement dispute between Osram and Shanghai Hongyuan Lighting Co., Ltd., one of the world's two major lighting manufacturers, has been settled with a paper decision from the Beijing Higher People's Court. According to the judgment of the Shanghai Higher People's Court and the Beijing Higher People's Court, the patent rights of the case filed by Osram have been invalidated. It is understood that Electric Light Patent Trust Co., Ltd. has obtained the invention patent of high-brightness electrodeless low-voltage light source after applying according to law. Since then, OSRAM has acquired the electric light company and obtained the above patent rights. In October 2005, Osram Company sued Hongyuan Company for the second-level intermediate people's court in Shanghai on the grounds that Hongyuan Company infringed its patent rights.
In the meantime, Hongyuan Company filed a request for invalidation with the Patent Reexamination Board of the State Intellectual Property Office for the patent rights involved. On August 18, 2008, the Patent Reexamination Board made a review decision: the patent rights involved in the case were all invalid. In December 2010, after two trials, the Shanghai Higher People's Court finally concluded that the technical solution used by Hongyuan Company was a simple combination of technical solutions and common sense that had been declared invalid, and did not constitute infringement.
To this end, Osram has filed a lawsuit with the Beijing No. 1 Intermediate People's Court. The case was also tried by the Beijing No. 1 Intermediate People's Court and the Beijing Higher People's Court. The Beijing Higher People's Court finally found the decision of the Patent Reexamination Board to declare the patent right invalid. The facts were clear and the applicable law was correct. maintain.
